Terms & conditions
Scope of application
The following term and conditions define the business relation between PAMÉ (here below mention also as we) and its customers (here below mentioned as you). These conditions has been accepted by you after you placed the first order. PAMÉ reserves the right to change these T&C anytime and you will be informed if a change occurs. The terms and conditions which are published on pameflowers.ch apply at the time of the conclusion of the contract.
Conclusion of Contract
The offers and prices published by pameflowers.ch are non-binding. The images of our products are examples. Since the flowers are subject to availability, the choice of flowers may vary accordingly to many reasons. As consequence, the choice of the flowers used is subject to our discretion. By clicking on the “ PLACE ORDER” button, you place a binding order for the chosen product which are contained in the shopping cart. Once the order has been sent, we will immediately email you with the order confirmation form. The contract is concluded when the customer receives the order confirmation. The acceptance of the contract is subject to the availability of the products which are ordered.
Prices and Payment
The prices are indicated in Swiss Francs (CHF) and include VAT. Price fluctuations in flowers due to seasonal or natural events are possible. The prices indicated at the time the order is placed are considered valid. Our products and services can be paid by credit card (Visa, MasterCard and American Express) and PayPal. We process the orders only if the payment is successful.
Without written consent from us, transferring and/or selling coupons and discount codes is not allowed. Combining special offers, coupons and discount codes is not possible.
Delivery
We deliver the products you ordered from Tuesday to Friday, to the address indicated in the order. You will select the delivery date for a single product or first delivery date of your subscription when you place your order. We deliver from 4pm to 7pm. The exact time of delivery is at our discretion, we do not offer specific time slots. We do not assume any liability for delivery delays. When you order your flowers please provide us with all the necessary information for a smooth delivery. As we work with partners (La Vélopostale and the Swiss Post), once the flowers are out for delivery we are unable to modify the delivery address. If there is no one present at the given address, the messengers will leave the flowers in front of the recipient’s door. You can specify where/how we should deposit your flowers otherwise at checkout. We are not responsible after we left the flowers in front of the door at the given address. The messengers will try their best to deliver on your chosen day, although, if the address is incorrect or incomplete and they are not able to deliver the flowers, Pamé will email you. If you do not hear from us it means your order has been delivered. If the address is incorrect we cannot refund your order. Because flowers are perishable we cannot offer re-deliveries.
Subscriptions
You can choose to pay for your subscription upfront and get a 5% discount or to pay by automatic withdrawal each delivery. Please note that your subscription will be automatically renewed if you don’t unsubscribe at least one week before your last delivery. You can pause your subscription anytime in your member area or by sending us an email at hello@pameflowers.ch. Should you change address or door code please remember to update the data. You can stop your subscription with a 5 working days notice, by accessing your member area . Should you change address or door code please remember to update your personal data also in your member area. All changes must be made at least one week in advance.
Reservation of Ownership, Withdrawal From the Contract
We reserve the right to retain property of the product if the payment fails. If we do not receive your payment after some email reminders from our side, we reserve the right to withdraw from the contract and recover any delivered products.
Health and Safety
Please note that our flowers are not edible. Our flower sushis are a ready to enjoy arrangement that come with their container : even if the foam is well protected with biodegradable cellophane, leaks could happen. It is your responsibility to protect the surface you place the sushi on.
Liability and Refunds
Our flowers last from 2 to 6 days. The exact lifespan depends on the type of flower. In their boxes, our bouquets can last for up to four hours without water. If you exceed this time frame, we do not accept any liability for the quality and condition of the flowers. It is your responsibility to receive the flowers during the indicated delivery time. If all the above conditions have been met and one of our bouquets still wilts on the second day it is in your possession, please contact us by sending us an image of the wilted flowers and your delivery data. If the damage is due to our mistake, we will replace the flowers free of charge in the best delay. No refund is provided. Our liability for your own fault and that of our employees is limited to intent.
Workshops
Concerning our workshops, due to covering costs of the venue, the flowers, catering and staff, we are only able to offer full refunds for cancellations on our workshops with 14 days’ notice. After that we will not be able to refund the amount paid, nor to transfer it to other Pamé workshops, but of course a friend can replace you!
Google Maps
We use Google Maps to visualise geographical information. Google also collects data about the way our visitors are using Google Maps on our website. You can find more information about Google’s data processing in Google’s privacy policy.
Google Analytics
This website uses Google Analytics. If you would like to deactivate Google Analytics, Google provides a browser plug in at https://tools.google.com/dlpage/gaoptout?hl=en. Google Analytics uses cookies. They enable an analysis of the way our website is used through Google.
This website uses features from Facebook Inc. Visiting our pages with Facebook plug-ins creates a link between your browser and Facebook servers. During this, data is transferred to Facebook. This data can be linked to your Facebook account, if you have one. If you do not wish to associate this data with your Facebook account, please log out from Facebook before visiting our page. User engagement like using the comment function or clicking on a “like” or “share” button also results in data being sent to Facebook. Our pages include function of the Instagram service. If you are logged in to your Instagram account, you can link the content of our pages to your Instagram profile by clicking on the Instagram button. Through this, Instagram can associate the visit of our website to your user account. We would like to point out that as the provider of the website, we do not know the content of the transferred data or how it gets used by Instagram.

Changes
We reserve the right to adapt this privacy policy without prior notice. The version currently published on our website is the once currently applying. The following privacy policy explains the data Pamé (hereinafter: we or us) collects when the Swiss domiciled customer (hereinafter: you) visits the Pamé website (hereinafter: our website), how we use it, how you can access it, and how it is protected. You need to confirm that you have read and understood our Privacy Policy before placing your first order with us.
Personal data
We offer a variety of services. In order for you to enjoy these services we collect a variety of data. Based on Article 13 of the Swiss Federal Constitution and on the Federal Act on Data Protection (FADP) every person has the right to privacy and protection against the misuse of their personal data. We treat your data confidentially and according to the above-mentioned law. When we talk about “data” we refer to “personal data”. It is your personal choice to share your data with us when you order a product, create a member area, subscribe to our newsletter or use the contact form. If you register on our website, we also store the personal information you provide in your user profile. You can see, edit, or delete your personal information at any time. In cooperation with our hosting providers, we do our best to protect our databases against hacking. Despite regular monitoring, complete protection against all risks is not possible.
Technical data
Some of the data we collect is technical data (visited pages, name of retrieved files, date and time). We receive this data by the devices and access that are automatically detected during the interaction with our services and they could refer to the type of appliance you use. We store this data for statistical purpose and we cannot trace it back to you. This data will be only used to improve our services.
How we use your data
Some of the data we ask for is imperative for you to enjoy the services we provide. Your data will be used to manage orders, customer care, newsletter, advertising about our offers and activities. If you do not wish your data to be used for these purposes, please see the section below on “Your rights over your data.”
Who we share your data with
Your data will not be shared with third parties, except with our partners in order to deliver the service or product you paid for or in case of a promotional collaboration with other brands.
Where your data is and for how long
Once you choose to share your data with us, it will be registered in our server in Switzerland and only used in Switzerland. Your data will be kept for a period of 10 years as required by Swiss law.

• Ask us any questions about this Privacy Policy.
• Receive an exported file of your personal data in our possession.
• Request that we delete any personal data in our possession. We will do so in the limits of our legal obligations.
• Request that we change the options selected automatically for the use of your data.
Third-party websites
Our website can contain links to other websites, ie. those of our partners in Switzerland. This Privacy Policy applies strictly to our website. We are not responsible for any use of your data while you access the websites of our partner companies that are completely independent legal entities from Pamé.

In simple terms, cookies are text files that reside on your computer. Cookies are created when you visit a website. They are used to store bits of information about your interactions with the website, which the web server can use later when processing your sessions. Our website uses cookies to improve your experience. For privacy reasons, you may wish to view the cookies currently stored in your browser or control which sites you accept cookies from. Please note that if you refuse the storage of cookies from our website, performance of our website might be affected.
Modifications
This Privacy Policy is a part of your agreement with Pamé when you place your first order. The version existing at the time of the conclusion of your agreement (as defined in the Pamé Terms and Conditions) will apply to the agreement.
